Pre-Disability Application Claim Consulting

Many of our clients choose to consult with our attorneys regarding the disability claim filing process while they are still working. If all long term disability claimants had such foresight, many unfair claim denials could be avoided. During an initial pre-filing consultation, the attorney and the client will normally review the client’s disability income policy or Summary Plan Description (SPD) if it is a group/employer sponsored policy. If you do not have these documents, we can advise you how to obtain them. We will discuss the “definition of disability” in your policy and what proof is required to win your claim. Some policies require that you only have to prove you are disabled from your “own occupation”, while others require you to be disabled from “any occupation”.

In addition, some policies have two-year durational limitations on mental disorders or disorders whose symptoms are largely self-reported, such as fibromyalgia and chronic fatigue syndrome. We will discuss your diagnosis, symptoms and treatment to date. We will discuss whether you may need additional testing or need to see additional doctors to strengthen your claim. We will discuss your current job description, and whether a vocational expert might be necessary to analyze you current work capabilities. Finally, we will explain the economic “big picture” of long term disability insurance claims, crunch some numbers and what you may expect from your particular disability insurance company in the future.
