ERISA Appeals and Terminations
ERISA is short for the “Employee Retirement Income Security Act of 1974”. ERISA governs your rights to appeal unfair group and/or employer sponsored long term disability denials and terminations. It is an extremely complex law and is generally not favorable to disability claimants. Some in the industry think the initials actually stand for “Every Ridiculous Idea Since Adam”! Despite the challenges of ERISA, experienced ERISA lawyers overturn unfair denials and terminations every day.
Based upon our firm’s reputation in the industry, our office was recently hired by a Senior Trial Attorney who worked “in-house” for one of the “big five” disability insurance companies. He was stricken with multiple sclerosis but his own company denied his long term disability claim! One of the disability claims examiners within the company gave him our firm’s name “on the QT”. After developing more medical and vocational evidence, we prepared a thorough ERISA appeal. His original denial was reversed in less than two weeks and he is currently receiving 60% of his monthly salary. You know your work is highly respected when your clients are attorneys and claims representatives in the disability industry.
We have handled appeals against almost every large disability insurance company in America, including Unum Group (formerly UnumProvident Corporation, the nation’s largest disability insurance carrier), Guardian, CIGNA, Prudential, Hartford, Met Life, Liberty Mutual, Aetna, Mass Mutual, Berkshire, Northwestern Mutual, Broadspire, New York Life, Equitable, AXA, MONY, Jefferson Pilot, Trustmark and Disability Management Services.
